How To Make a Living Will

“Wills speak at the time of death”. This is a very old saying, but still so applicable today! Your will is your voice after you die. Your last will and testament is a legal document in which you can express how you want your property to be distributed after your death, who you want to be in charge of said distribution and who will take care of your kids. In a will, you can also provide for your pets, your great grandmother’s silverware, your coin collection, your antiques and anything else you want to end in a certain person’s possession.

If you die without a will, you are said to have died intestate. In that case the law of the state in which your property is located will determine the way your property will be distributed after your death, regardless of what your wishes were. If you want to have a word on who is going to get what from the property you leave behind, you must have a will. A simple will is the only way you can control what is going to happen with all your affairs after you die.

You can, if you wish, just write your Will yourself. You do not even have to do it on a computer or have it typed out. You can simply create the necessary document by writing it out by hand. You should carry out all of the necessary legal requirements to do with witnessing it and so on, but it is perfectly possible to do everything yourself. There are mountains of ways of getting further knowledge on this subject. You can look at the internet but a much better idea is to get a book that tells you everything that you need to know. On line book shops will have a selection and you can also check your local public library if you want to carry out the research for free. You can purchase kits that provide help and advice about writing your Will. They normally give the basic legal requirements and some help on the various things that you need to bear in mind. Crucially, they also include a template or form that you can complete. This makes things very easy but would probably only suffice for people who have relatively straightforward affairs. These might not be sufficient if you have children or more complex matters. They are probably not going to be a great deal of help if you want to reduce tax liabilities either. Another advantage of having a will is that in it you can designate an “executor”, a personal representative that will take charge of winding up all your financial affairs. This person, obviously someone you trust, will take your will to probate court. The probate court will determine the validity of your last will. It will determine if your will complies with all the law requirements in your state. If the court finds that your will is valid, your will is probated. That is, everything you stated in your will take place accordingly to your instructions. The court will appoint the person you chose to be your personal representative. The rest of the process will be handled by the personal representative under the court’s supervision.

Friends and Relationship

What is your definition of a true friend?

Well most start with: someone who is there when you need them, someone who really cares, someone who will listen when no one else will, someone who is empathetic and understanding etc.

Such criteria are usually based on the premise that “when I’m in some kind of pain and need someone to be there only a true friend will be there.”

Well under what circumstances does someone really need someone else to be there for them? Well when they’re experiencing a difficult situation and are therefore in the role of a victim. In such cases the “friend” assumes the supporting role and therefore bears some of the pain.

Now I ask you, does this sound like a loving thing to ask of another human being, to ask them to assume some of your pain? Well some might think and do so on a regular basis.

Or does it feel manipulative and exploitative? Many such “friends” do in fact feel exploited. How do I know this? Well you hear it all around you.

For instance it’s common knowledge that those individuals who make such contracts with each other often secretly “keep score” with their “friends” to see whether they are getting their own personal needs met as well. When they aren’t you can over hear them talking to third parties about how “my friend always expects me to support him/her and rarely gives me much in return”?

Hence such a “friendship” is based on a covert contract of mutual exploitation yet many accept this as normal. Ironically they also think that complaining about it is also normal!

Why do such relationships exist at all? Well there are many reasons but I will outline what I feel is the major one.

A Longing to Uplift Them

When formulating the relationship, you carefully observe their body language and become tuned into their moods and mannerisms. You become so aware of their way that you can diagnose their emotions from how they carry themselves. When they are visibly down, you notice and empathize with their struggle. A close friendship reaches out to bring a timely word or touch to uplift their loved one.

Breaking Relationship - Divorce

For example, in most countries the law forbids a man or woman from marrying his sister or brother, and a person may not marry his grandmother, and one must be able to understand the nature of marriage and the duties and responsibilities that go with it – in other words be of sound mind. In most countries, a person who is considered a minor must have their parents consent and where the parents are separated, the parent with whom the minor is living with gives written consent. There are other issues involved when it comes to the marriage of a minor and these rules are there for very good reason.

A marriage is considered valid by the issuing of a marriage certificate and in most Canadian Provinces the department involved in Married Certificates is referred to as “Vital Statistics” which is a Government office. Usually to obtain a Marriage Certificate the couple must apply together at least 24 hours before their wedding unless the time frame is waived because of unusual circumstances.

One bit of unhappy marriage advice that you typically don’t hear is to accept that the marriage isn’t the same as it used to be. If your spouse has been pulling away physically and emotionally from you, it can feel overwhelming. If you still love them and you suspect that they have fallen out of love with you, it leaves you feeling very alone and confused.

Parental concerns – If the couple has children, there are several things that need to be considered during a divorce.  Topics of concern include who and how decisions will be made for the children.  Where they will live, the contact they will have with each parent and how their needs will be paid for are also important considerations.  Because children are often “caught in the middle” of a war waged by the two people they love, communication between the parents and with each of the children will assist everyone during and after the transition.

Emotional concerns – Frequently parents are so angry, upset, hurt or resentful that they consciously or unconsciously sabotage the divorce process.  The result is further hurt and negative emotions as well as additional lawyer’s fees.  When one person doesn’t provide information, attend meetings or work towards resolution of issues, both parties as well as the children are affected.
